Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, members, and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
I - Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
Your account is for personal use only, and only you, the subscriber, can use the Service.
II - Payments & Fees
1. Membership fees
To get access to the Service, you have the choice between paying a monthly, bi-annually, or yearly membership fee, respectively 18 euros/month, 99 euros/biannually or 180 euros/year. You agree and understand that by using the Service, you are responsible for paying the membership fee you subscribed to and will be automatically debited at the end of each billing period until you terminate your account.
Failure of payment will result in the impossibility of accessing to the Service.
We reserve the right to change the price of the membership at our sole discretion.
2. Payment information
Your payment information such as, but not limited to, credit card number, isn't stored nor known by Noémie Clémenceau. The Service https://studio.mouvements-modernes.eu is using a secured payment method provided by Stripe to proceed to payments. III - Free trial, Refunds & Right to retract
1. Free trial
A free 7-day trial period starts from the day of subscription for you to decide whether you want to continue using the Service or not. You are free to cancel your subscription at any moment during the free trial without being charged. If you don't cancel your subscription during that time frame, you will automatically be charged for the membership you subscribed to after the free 7-day trial period ends.
2. Refunds
After the trial period, refunds for monthly membership subscriptions cannot be granted.
For biannually membership subscriptions, a pro-rated refund of 69 euros can be granted if asked within one month (30 days) after signing up to the virtual studio.
For yearly membership subscriptions, a pro-rated refund of 150 euros can be granted if asked within one month (30 days) after signing up to the virtual studio.
No refund will be granted after that. Contact us to arrange your refund.
3. Right to retract
The Service provides digital content delivered on an intangible medium, entirely accessible from the day of subscription.
Section 6, Article L221-27 of the Code de la Consommation in the French legislation states that the right to retract doesn't apply to "Contracts supplying digital content not delivered on a tangible medium which execution has begun after the consent of the consumer and waiver of his right to retract."
By agreeing to the Terms and Conditions of the Service, you understand and accept that you waiver your right to retract.
IV - Behavior
By using the Service, you are agreeing to NOT do any of the following actions and behaviors :
- Insulting, harassing, threatening, discriminating, humiliating, or stalking users or the Service provider
- Saving and collecting data from the users or the Service provider without their consent
- Uploading, sharing, and posting inappropriate, obscene, and unlawful content
- Using the Service for spamming or promoting a business, product, or service
- Any action or behavior that has the intent to harm, disrupt, or damage the functioning of the Service
Your account will be automatically terminated if your behavior doesn't follow the Terms and Conditions you are agreeing to.
V - Termination
We may terminate or suspend access to our Service immediately, without prior notice or liability, for any abuse in the use of the Service.
Upon termination, your right to use the Service will cease at the end of your billing period.
If you wish to terminate your account, you may simply discontinue using the Service by canceling your account at any moment. You can cancel your account by going to "My Account", "Membership", and click on "Cancel membership". Your account and its information will be deleted within 30 days.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
VI - Use of the Service
By accepting the Terms and Conditions, you are agreeing to not sue Noémie Clémenceau for any physical or material damage resulting from using the Service.
By using the Service, you acknowledge that all physical activity poses a risk and that you are responsible for your own health. Noémie Clémenceau is not a medical professional. No information on this website should be taken as medical advice. You should consult a physician before beginning any new type of physical activity or exercise.
VII - Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Noémie Clémenceau and its licensors. You are not allowed to record, download, copy, nor share the content represented on https://studio.mouvements-modernes.eu.

Our Service may contain links to third-party websites or services that are not owned nor controlled by Noémie Clémenceau.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
XI - Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least a 30-day notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
